How A DUI Conviction Affects Your Professional License In Maryland

DUI38

You studied for years to earn your license. You built a career on it. So what happens when a single night behind the wheel threatens all of it?

Many licensed professionals assume a DUI is a personal matter that stays separate from their career. That assumption can be costly. In Maryland, a growing number of licensing boards treat criminal convictions, including driving under the influence, as fair game for professional review.

Which Licenses Are Actually at Risk?

Curious whether your particular license is exposed? The honest answer is that it depends on your field, but few professions are entirely insulated.

Physicians and nurses answer to boards with broad authority to review conduct that reflects on fitness to practice. Attorneys report to the Attorney Grievance Commission. Teachers, real estate agents, commercial drivers, and many other license holders face their own reporting rules and their own regulators, each with a different tolerance for a criminal record.

What ties these professions together is a shared expectation: the public trusts licensed professionals to exercise sound judgment, and a conviction can raise questions about whether that trust still holds.

Why Do Boards Get Involved at All?

Isn’t a DUI a criminal matter, separate from your day job? Not necessarily. Maryland’s Health Occupations Article grants disciplinary panels the authority to reprimand, place on probation, suspend, or revoke a license, and a criminal conviction can factor into that decision (Md. Code Ann., Health Occ. § 14-404). Many boards also require licensees to affirmatively report convictions, often within a set window after the case resolves. Failing to disclose can sometimes create a separate problem on top of the original charge.

Once a report reaches a board, what follows isn’t automatic. Some boards open an investigation, request records, or ask the licensee to respond in writing. Others may take no action at all if the case appears to be an isolated incident with no bearing on professional duties. The board typically looks at the whole picture: how serious the offense was, whether it’s a repeat occurrence, and whether it connects to any pattern relevant to the profession, such as substance use in a healthcare setting.

Does One DUI Automatically End a Career?

Not usually, but the range of possible outcomes is wide. A first offense with no aggravating factors might result in nothing more than a note in a file. A conviction involving a high blood alcohol concentration, an accident, or a repeat pattern can lead to a full investigative process and, in serious cases, license restrictions.

Timing matters too. Some boards want prompt disclosure, and delay in reporting can itself become an issue separate from the underlying offense. If you hold a license and are facing a DUI charge, understanding your board’s specific reporting rules, before your license renewal comes due, is worth prioritizing.
